Terms of Service

1. Overview

These Terms of Service (“Terms”) govern your access to and use of the Appsparks website and services (“Services”). By accessing or using the Services, you agree to these Terms.

2. Services

Appsparks provides professional translation, editing, and content creation services, including ghostwriting for fiction and non-fiction books. Specific deliverables, timelines, and fees are agreed in a written proposal or statement of work (“SOW”).

3. Engagement & Payment

• Bookings are confirmed upon written acceptance of an SOW and, where applicable, an upfront deposit.
• Invoices are due within 14 days unless otherwise stated. Late payments may incur interest permitted by law.
• All fees are exclusive of applicable taxes.

4. Client Responsibilities

You are responsible for providing accurate information, timely feedback, and necessary source materials. You represent that you own or have rights to materials you provide.

5. Intellectual Property

• Upon full payment, final deliverables are assigned to you unless the SOW states otherwise. Pre-existing tools, methods, and know-how remain the property of Appsparks.
• For translations, you confirm you hold rights to the original text and have authority to commission the translation.

6. Confidentiality

Both parties will keep non-public information confidential. Appsparks may reference non-confidential, publicly launched work in a portfolio unless you expressly opt out in writing.

7. Revisions

Reasonable revisions are included as set out in the SOW. Material scope changes may require a change order and additional fees.

8. Cancellations & Refunds

You may cancel with written notice. Completed work and committed time are billable. Deposits may be non-refundable if stated in the SOW.

9. Warranties & Disclaimers

Services are provided “as is.” While high standards are maintained, Appsparks does not warrant that deliverables will be error-free or achieve specific outcomes.

10. Limitation of Liability

To the fullest extent permitted by law, Appsparks will not be liable for indirect, incidental, or consequential damages. Aggregate liability is limited to the fees paid for the specific SOW giving rise to the claim.

11. Compliance

You are responsible for legal and regulatory compliance relating to how you use deliverables (e.g., claims in marketing copy, publishing regulations).

12. Governing Law

These Terms are governed by the laws of Lithuania. Disputes will be subject to the exclusive jurisdiction of the courts in Kaunas, Lithuania.
